Terms of Service

1. Acceptance

By creating an account on AtMyBoat.com or using the d3kOS software, you agree to these Terms of Service. If you do not agree, do not use our services. These terms apply to all users, including T0 (software only), T1, T2, and T3 account holders.

2. The Service

AtMyBoat.com provides:

  • The d3kOS open-source marine intelligence software (available under GPL v3)
  • A community forum for marine electronics and boating discussion
  • A mobile companion app (PWA) for monitoring d3kOS installations
  • Paid services: Fix My Pi diagnostics ($29.99/incident or included in T2/T3), PDF boat reports (T2/T3), and subscription tiers (T2: $9.99/month, T3: $99.99/year)
  • A marketplace for community buy/sell of marine equipment
  • A business directory for marine service providers

3. Accounts

  • You must be 18 or older to create an account.
  • You are responsible for maintaining the security of your account and password.
  • You must provide accurate information at registration. False information may result in account termination.
  • One account per person. You may not share accounts.
  • You are responsible for all activity under your account.

4. Community Forum Rules

  • Be respectful. Personal attacks, harassment, and hate speech are prohibited.
  • Post only marine-related, on-topic content in forum categories.
  • Do not post spam, advertising (outside the designated marketplace), or promotional links.
  • Do not post dangerous advice that could endanger life or property without appropriate caveats.
  • You own your posts. By posting, you grant AtMyBoat.com a non-exclusive license to display your content on the platform.
  • We reserve the right to remove content that violates these rules without notice.

5. Marketplace

The marketplace is a free listing service for community members to buy and sell used marine equipment.

  • AtMyBoat.com is not a party to any transaction between buyers and sellers.
  • We are not responsible for the quality, safety, legality, or delivery of any listed item.
  • Buyers and sellers transact entirely at their own risk.
  • Listings must be for genuine marine-related items. Off-topic listings will be removed.
  • No fraudulent listings. Accounts posting fraudulent listings will be permanently banned and reported to authorities where appropriate.

6. Fix My Pi Service

  • Fix My Pi is a diagnostic and restoration service. It restores your d3kOS installation to a working state — it does not upgrade, improve, or modify beyond restoration.
  • The service operates on a best-effort basis. We do not guarantee that every issue can be resolved remotely.
  • Fix My Pi requires your Pi to be powered on and connected to the internet during the diagnostic.
  • T0/T1: $29.99 per incident, charged via Stripe before the diagnostic runs. No refunds once the diagnostic has been initiated.
  • T2: 3 free checks/month included in your subscription. Unused checks do not roll over.
  • T3: Unlimited checks included in your annual subscription.

7. Subscriptions and Payments

  • T2 ($9.99/month) and T3 ($99.99/year) subscriptions are processed by Stripe.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • To cancel, email skipperdon@atmyboat.com at least 24 hours before renewal.
  • No partial refunds for unused subscription periods.
  • Prices are in Canadian dollars (CAD) unless otherwise stated.

8. d3kOS Software

d3kOS is open-source software licensed under the GNU General Public License v3 (GPL v3). The GPL v3 license governs your use of the software. Cloud services (Fix My Pi, PDF reports, the mobile app backend) are separate from the open-source software and are provided under these Terms.

Using d3kOS on your vessel is entirely at your own risk. Marine navigation and vessel operation involve inherent dangers. d3kOS is a supplementary tool — it does not replace certified navigation equipment, proper seamanship, or your own judgement. Never rely solely on d3kOS for safety-critical decisions.

9. Limitation of Liability

To the fullest extent permitted by Ontario law:

  • AtMyBoat.com is provided "as is" without warranty of any kind.
  • We are not liable for any damage to your vessel, engine, electronics, or other property arising from your use of d3kOS or any advice obtained through the platform.
  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
